Austrian Regulator rules against Swiss Hotel Website

The Supervisory Authority for Austria has published its findings from an investigation into a breach of Article 13 of the GDPR by a Swiss Hotel Company in January 2019. 

The company, while not based in the EU, did provide services to EU citizens and also handled bookings for hotels in Austria.

A complaint was raised by a data subject when they had requested to be unsubscribed from email marketing but continues to receive it. Subsequently, the organisation was unable to provide precise information on which third-parties it was sharing data with or who their representative within the EU was.

Problems were also highlighted with their privacy notices, which went unresolved for over four weeks after they had been raised.
